在罗马帝国后期,随着日耳曼人与罗马文化的接触,及日耳曼王国的建立,开启了日耳曼人力求将部落习惯化为成文法典之渐,作为日耳曼王国中存在时间最长、在历史上影响最大的法兰克王国自然也不例外。不过,我们对早期法兰克人的立法活动知之不多,在过去很长时期内,法兰克王国因为其颁布的法典所具有的明显的日耳曼特征而被认为是最早颁布法典的日耳曼王国,但是近年来,随着研究的深入,学术界对此有了新的共识,开始一定程度地肯定这样一种观点,即最早的法兰克人的法典的出台实际上要晚于最早的西哥特人和勃艮第人的法典。
