共同危险行为的归责包括共同危险行为的归责基础和共同危险行为的归责原则两大内容。共同危险行为归责基础设立的目的是来解决共同危险行为人承担责任的理论依据,而共同危险行为的归责原则是对现实中出现共同危险行为的具体法律适用。本文通过对共同危险行为归责的探讨,力求从理论上对共同危险行为作进一步的阐述,使其在实践中能够准确适用。
The responsibility of the common risk behavior includes the principle of attribution of the common risk behavior and the principle of liability of the common risk behavior. The purpose of the establishment of the common dangerous behavior attribution foundation is to solve the theoretical basis that the common dangerous actor assumes the responsibility, and the principle of imputation of the common dangerous behavior is the specific legal application of the common dangerous behavior in reality. Through the discussion of the blame for common dangerous behaviors, this article tries to elaborate the common dangerous behaviors theoretically and make it practically applicable.
