“住改商”推动着城市商业和文化的发展,具有存在的合理性,同时也是金融危机下各地鼓励“创业带动就业”的措施之一,物权法的施行更是确立了其合法地位;而不容争辩的事实是“住改商”必然对周边住宅带来影响,有积极的惠民影响,也有消极方面。“住改商”在法律和政策上的几经反复,反映出了“住改商”问题的复杂性。“住改商”问题的解决很大程度上取决于法律与政策的规定对市场的规制程度。对此,作者认为应对不同“住改商”模式区别对待。
