市民社会是民法发展和民法精神孕育的基础。民法是市民社会的基本法则,是对市民社会基本关系的法律调整。民法典的制定对一个国家来说在形式上意味着私法意识的建立,在实践上意味着自由与平等真正的纳入这个国家的民众生活和公共社会秩序中。本文从市民社会的源流和变迁出发,对古代社会到清末修律运动再到近现代社会来分析我国市民社会的形成过程,论证市民社会市民法典指定的基础。
Civil society is the foundation for the development of civil law and the spirit of civil law. Civil law is the basic law of civil society and the legal adjustment of the basic relations of civil society. The formulation of the Civil Code formally means that the establishment of a private law consciousness for a country means in practice that freedom and equality are truly incorporated into the public life and public order of the country. Based on the origins and changes of civil society, this article analyzes the forming process of our civil society from the ancient society to the law-abiding movement in the late Qing Dynasty to the modern society and demonstrates the basis for the designation of the civil code of civil society.
