法律关于特殊疾病医疗期规定的矛盾导致对特殊疾病的医疗期期限可以有不同的理解,这会导致不同的裁决结果。要解决这个问题,可以由地方政府制定《医疗期规定》实施细则,也可以由人力资源和社会保障部发布批复或补充规定。特殊疾病的医疗期的延长应根据企业和劳动者的实际情况协商予以确定。
The conflict between the law’s provisions on the duration of medical conditions for special diseases leads to a different understanding of the duration of the medical period for specific diseases, which leads to different findings. To solve this problem, local governments may formulate the implementation rules of the “medical period regulations” or issue the replies or supplements by the Ministry of Human Resources and Social Security. The extension of the medical period for special diseases should be determined on the basis of the actual situation of the enterprise and the workers.
