新修订的《信访条例》于2005年5月1日起施行。新修订的《信访条例》充分体现了党的宗旨和以人为本的理念,体现了民主与法制的精神,体现了构建社会主义和谐社会的要求。为了使条例的基本精神更好地为广大干部群众所掌握,笔者就新修订的《信访条例》涉及的有关内容作以解读。新修订的《信访条例》规定信访人应当享有的权利和义务是什么?新修订的《信访条例》规定了信访人既享有宪法和法律赋予的权利,也应当履行相应的义务。信访人的权利包括:提出信访事项的权利;获得相关信息的权利;查询信访事项办理情况的权利;得到书面答复的权利;要求复查复核的权利;不受打击报复的权利。信访人的义务包括:按法定程序提出信访事项的义务;遵守走访形式规定的义务;如实反映情况的义务;维护信访秩序的义务。信访人的六项法定权利1、提出信访事项的权利。规定信访人对下列组织、人员的职务行为反映情况,提出建议、意见,或者不服下列组织、人员的职务行为,可以向有关行政机关提出信访事项:(1)行政机关及其工作人员;
The newly revised “Petition Ordinance” came into force on May 1, 2005. The newly revised “Petition Ordinance” fully embodies the party’s principle and people-oriented concept, embodies the spirit of democracy and the legal system, and embodies the requirements of building a socialist harmonious society. In order to make the basic spirit of the regulations better mastered by the masses of cadres and masses, the author interprets the relevant contents involved in the newly revised Petition Ordinance. What is the right and obligation that the petitioners and petitioners should enjoy in the newly revised Petition Ordinance?
