《劳动合同法》出台之后,劳务派遣中存在的争议得到了缓解,但是越来越多的用人单位又企图使用隐蔽用工的方式来降低雇佣成本,侵犯劳动者的合法权益,逃避法律责任。近两年,超市中的销售女工的隐蔽用工问题日益受到关注,究其原因,社会发展的过渡阶段的不足和法律条文的漏洞承担着不可推卸的责任。要有效解决这一问题,还要遵循客观事实,从国内外的成功经验出发探讨解决对策。
After the introduction of the Labor Contract Law, disputes over labor dispatch have been alleviated. However, more and more employers also attempt to use hidden employment methods to reduce the employment costs, violate the legitimate rights and interests of workers and evade legal responsibilities. In the past two years, the issue of the hidden employment of sales women workers in supermarkets has drawn increasing attention. The reason for this is that the lack of transitional stages of social development and the loopholes in legal provisions bear unshirkable responsibility. To effectively solve this problem, we must also follow the objective facts and proceed from the successful experiences both at home and abroad to explore solutions.
