惩罚性赔偿的实质在于权利人所获得的赔偿金大于其损失，该原则只能作为补偿性原则的例外和补充而存在。我国现行法律针对知识产权侵权损害赔偿责任所确立的全面赔偿原则不仅符合民事法律的基本原理，而且也符合TRIPS协议所规定的保护标准。我国没有义务，也没有必要将惩罚性赔偿引入到知识产权法中。
