个案急呈申请人范某系某汽车维修厂职工,双方在劳动合同中约定每月工资待遇3000元,试用期为三个月,但没有约定试用期的工资标准。发工资时,单位只按当地的最低工资标准发给其试用期工资,范某对此表示异议,要求单位按不低于每月工资的80%标准发试用期工资。单位则认为,只要不低于最低工资标准1300元就合理、合法。无奈,申请人向当地的劳动人事争议仲裁委员会申请仲裁。
