二十世纪初,国际社会上出现了“国际强行法”这样一个新兴的国际法的概念。但在当时,这个新话题并没有引起广泛的关注,有关国际强行法的定义和内涵在国际法学领域长期以来观点不一。直到第二次世界大战的爆发,国际强行法理论得到了迅速发展的契机。1965年《维也纳条约公约法》的签订,使国际强行法成为维护世界秩序的一种法律规范。本文通过探寻国际强行法的定义与特征,以及其与国内强行法的共同点和国际强行法的约束力三方面,揭示出国际强行法的重要意义。
At the beginning of the 20th century, the concept of an emerging international law such as “international coercion” appeared on the international community. However, at that time, this new topic did not attract wide attention. The definition and content of international coercive power have long been different in the field of international law. Until the outbreak of the Second World War, the theory of international law of jus cogens got a chance of rapid development. The signing of the 1965 Vienna Convention on the Convention on Treaties made international jus cogens law a legal norm for the preservation of the world order. This article reveals the significance of international coercive law by exploring the definition and characteristics of international coercive law, as well as its commonalities with domestic coercive law and the binding force of international coercive law.
