正式解释应该划分为专门解释和普通解释(一般解释),目前全国人大常委会只认可了专门解释,忽视了客观存在的普通解释。其中,实施性法规、规章、其他规范性文件、地方法院关于适用法律法规及司法解释的规定被称为抽象性(规范性)普通解释,法官、仲裁员及执法人员对于这些文件的解释说明被称为具体性(个案性)普通解释。由于某些地方国家机关的亲雇主立场、某些地方国家机关工作人员的民法思维,以及他们的社会角色错位,导致《劳动合同法》的法律解释出现了很多问题。应该完善《劳动合同法》法律解释,主要是废除违法解释、完善司法解释,并确立普通解释的原则。
