住房专项维修资金归全体业主所有,主要是在房屋保修期满后,物业共用部位、设施设备维修、改造以及更新过程中使用,它的缴存、归集、管理、实际使用以及监督涉及到千家万户,不仅直接关系到广大业主的自身利益,而且还与社会公共利益有着密切的关系。当前,我国的商品住房市场得到了快速发展,大量的商品住房以及销售出去的公有住房已经进入大中维修期,进而暴露了住房专项维修资金使用过程中的诸多问题,因住房专项维修资金而导致的纠纷屡见不鲜。本文首先指出了住房专项维修资金制度中存在的问题;其次,建议相关部门尽快完善、落实住房专项维修资金管理措施,确保住房专项维修资金专款专储,专款专用,保值增值。
