预告解除劳动合同是指劳动者或用人单位任何一方在签订劳动合同之后,预先通知对方想要解除劳动合同的意愿,在经过一定的期间后而自动解除合同的行为。《劳动合同法》对于《劳动法》中的部分内容都进行了完善,但是依然没有改变立法倾斜于普通劳动者这一状态,预告义务之所以出现相关问题,很大一部分原因是现行的用人单位预告解除劳动合同制度存在着一定的缺陷。这不仅损失了企业的部分权益,同样也会使得劳动者的合法权益无法收到应有的保护。本文将以用人单位预告解除劳动合同的相关问题入手,分析目前预告义务在实行与发展中的现状以及存在的问题。
