刑法应当合理反映社会公众共享的有关定罪量刑、刑事谴责及刑罚公平的理念。刑事法律体系体恤民意具有实用性功能。有效蕴含社会公众直觉正义观念的刑事法律制度不仅能够体现刑罚报应的公平性,而且有助于实现犯罪预防与控制的实用功能。以民意认可的公正观点与方式分配刑事责任的刑事法律体系,可以获得社会公众的道德信赖,使得受到刑事法律规范调控的社会群体形成更好的规范遵循,从而提升刑法震慑效果。刑事司法应在个案中审慎保留与民意的距离,互联网与传统媒体舆论所形成的“民意”深化了在司法程序中接纳民意的风险。
The criminal law should reasonably reflect the concepts of conviction, criminal condemnation and fairness of punishment shared by the public. Criminal legal system compassion and opinion have practical function. The criminal legal system effectively containing the concept of intuition and justice of the public can not only reflect the fairness of retribution but also help to realize the practical function of crime prevention and control. The criminal legal system of assigning criminal responsibility with public opinions and ways of impartial approval can gain the public’s moral trust and make the social groups regulated by the criminal law form a better standard to follow and thus enhance the deterrent effect of criminal law. Criminal justice should carefully preserve the distance from public opinions in individual cases and the “public opinion” formed by the Internet and traditional media deepens the risk of accepting public opinion in judicial proceedings.
