案例回放:冯某原是某药业有限公司职工,2010年12月3日调至某针织厂工作。2010年12月22日,原单位某药业有限公司为冯某补缴了2003年2月至2009年12月的工伤保险费。2011年1月31日冯某工亡,某针织厂于2011年2月21日至2011年8月25日期间,分8次为冯某补缴了2010年6月至2011年1月的工伤保险费。2011年4月21日,当地人力资源和社会劳动保障局作出工伤认定决定,认定冯某之死为工伤。当冯某的亲属提出申请支付工伤时,社保局却以“此类工伤职工的工伤待遇应由用工单位支付”为由,拒绝支付。于是,冯某的亲属向法院提起行政诉讼,请求判令
