根据2006年8月27日全国人大常委会第23次会议审议通过的《中华人民共和国企业破产法》(以下简称企业破产法)的相关规定,最高人民法院先后制定了《最高人民法院关于审理企业破产案件指定管理人的规定》、《最高人民法院关于审理企业破产案件确定管理人报酬的规定》和《最高人民法院关于<中华人民共和国企业破产法>施行时尚未审结的企业破产案件适用法律若干问题的规定》等3个司法解释(上述法律和司法解释已于2007年6月1日起开始施行)。为配合企业破产法的施行,最高人民法院关于适用企业破产法的司法解释起草工作最近业已展开。本期邀请几位资深法官对破产法适用中一些新问题发表意见和建议,也希望广大读者踊跃参与,发表个人的真知灼见。
According to the relevant provisions of the “PRC Bankruptcy Law of the People’s Republic of China” (hereinafter referred to as the Enterprise Bankruptcy Law) passed at the 23rd meeting of the Standing Committee of the National People’s Congress on August 27, 2006, the Supreme People’s Court has formulated the “Provisions of the Supreme People’s Court on Trial Enterprises The Provisions of the Designated Administrator of Bankruptcy Cases, the Provisions of the Supreme People’s Court on Determining the Remuneration of Managers in Handling Enterprise Bankruptcy Cases and the Law Applicable to the Enterprise Bankruptcy Case of the Supreme People’s Court on the Implementation of the Enterprise Bankruptcy Law of the People’s Republic of China Provisions ”and other three judicial interpretation (the legal and judicial interpretation of the June 1, 2007 came into effect). In line with the implementation of the bankruptcy law, the Supreme People’s Court recently started to draw up judicial interpretations on the application of the enterprise bankruptcy law. In this issue, several senior judges are invited to express their opinions and suggestions on some new issues in the application of the Bankruptcy Law. We hope that the readers will participate in this forum and express my personal opinions.
