“小产权房”至今在我国法律中尚无明确规定,由“小产权房”引发的法律问题和诉讼纠纷不断。对于如此大规模的“小产权房”如何处理显然已经成为社会焦点问题。文章从法律制度和经济社会发展角度,探求“小产权房”产生的原因,结合农村和城市的关系、房地产市场的发展和稳定社会等一系列因素考量“小产权房”对我国法律和社会的影响,从而认为“小产权房”合法化有着必要性。从现有法律法规冲突和法律的原则与修改方面分析认为“小产权房”合法化具有可能性。因此,应当积极从法律制度和政策上对“小产权房”采取合法化的措施,为“小产权房”在法律上寻找一个突破口,并且也使现存的“小产权房”有合理的出路,从而使“小产权房”这一问题得到彻底解决。
