关于法律与社会的关系,西方传统法律理论中流行着一种“镜像命题”:法律就像一面镜子一样反映着社会中的习俗和道德,其功能在于维持社会秩序。在《法律与社会的一般法理学》一书中,塔玛纳哈对“镜像命题”提出了批判,认为它并不能解释非西方社会的情形,甚至也不能解释当代西方的情形。以这种批判为基础,塔玛纳哈构建了一个研究法律一社会关系的一般性的框架。这个研究框架具有开放性、灵活性等特点,为关于法律一社会关系的研究开辟了广阔的空间。
With regard to the relationship between law and society, there is a kind of “mirror image proposition” prevailing in the traditional western legal theories: Law mirrors the customs and morals in society as a mirror, and its function is to maintain social order. In his book, Law and Society in General Jurisprudence, Tamanja put forward a critique of “Mirror Proposition ” that it can not explain the situation in non-Western societies and can not even explain the situation in contemporary West. Building on this critique, Tamannaha has constructed a general framework for the study of law-society relations. The research framework is open and flexible. It opens up a vast space for the study of the relationship between law and society.
