政府权力清单是法治政府建构的现实路径。以民主政治为基础的政府权力清单制度,应以行政法架构下的行政组织法、行政程序法和信息公开法的实现为前提,这是政府权力清单的实现基础。建构实践中,还应明确并解决政府权力清单的规范化问题、清单列举的理性论证和行政权社会化发展等现实问题。
The List of Government Power is the Realistic Route of Constructing the Government by Law. The system of government power list based on democratic politics should be premised on the realization of the administrative organization law, the administrative procedural law and the information disclosure law under the framework of administrative law, which is the basis for the realization of the government power list. In the practice of construction, we should also clarify and solve the problems concerning the standardization of the government power list, the rational argumentation listed in the list, and the socialization of administrative power.
