质量技术监督作为国民经济中宏观调节系统的一个监管层面,担负着产品质量监督管理、计量工作统一管理、净化市场环境的职责,其执法监管职能更为突出。客观地说,质量技术监督机关尽管付出了较大的努力,也取得了一定的成绩,但监管效果离目标要求还有相当的距离,其中,行政强制执行的弱化是一个非常重要的原因。本文拟从界定行政强制执行的含义、性质入手,通过对我国质量技术监督机关强制执行的现状进行分析,以期进一步厘清如何强化质量技术监督机关行政强制执行。
As a regulatory aspect of the macroeconomic regulation system in the national economy, quality and technical supervision assumes the responsibility of product quality supervision and management, unified management of measurement work, and purification of the market environment, and its supervisory and regulatory functions are more prominent. Objectively speaking, although the quality and technical supervision organs have made great efforts and obtained some achievements, the supervisory effect is still far from the target requirements. Among them, the weakening of administrative enforcement is a very important reason. This article intends to define the meaning and nature of administrative enforcement, and analyzes the status quo of enforcement of quality and technology supervision authorities in our country with a view to further clarifying how to strengthen the administrative enforcement of quality and technical supervision organs.
