要获得正当性法律解释,必须符合四个方面的要求:实体上,必须有一套完备的制度保障机制,司法的职业性、司法的民主性和司法的独立性是其核心内容;程序上,必须形成充分的意见竞争机制;立场上,必须坚持司法克制主义的立场;方法上,必须坚持文义解释优先的原则。以上四个方面是从一般意义上对获得正当性法律解释提出的要求,适用于所有部门法的法律解释。值得我们注意的是,对于任何一部具体的部门法,针对其法律解释应该有其独特的要求。
In order to obtain legal explanation of legitimacy, it is necessary to meet the requirements of four aspects: In substance, there must be a complete set of institutional guarantee mechanism. Judicial professionalism, judicial democracy and judicial independence are the core contents. Procedurally, Form a full mechanism of opinion competition; on the position, we must adhere to the position of judicial restraint. On the method, we must insist on the principle of precedence explained by the text. The above four aspects are requirements for obtaining legal interpretation of legitimacy in a general sense and apply to the legal interpretation of all sectoral laws. It is worth noting that for any specific departmental law, there should be unique requirements for its legal interpretation.
