沈阳市文化用品经销公司贾明问: 1996年1月15日,我公司与某商场签订了一份牛皮纸购销合同。合同约定由我公司为该商场提供牛皮纸800吨,每吨价格为2350元,总货款为1880000元;每月交货200吨,履行完毕为止;每批交货前20日,该商场向我公司预付该批货物的40%的货款,余款在货到验收后5日内付清;运费由我公司承担。合同签订后,某商场即交付了首批货的预付款计188000元。我公司也如期履行了合同义务。但在办理第二批货物的运输过程中,由于运输部门的原因,致使我公司到期不能交货。为此,某商场以我公司违约为由提出解除合同,并要求我公司承担违约责任。请问在什么情况下才构成违约?我公司不能完成交货任务责任完全在于运输部门,是否应直接由运输部门承担违约责任呢?
