民事行为制度作为大陆民法的重要制度之一,蕴涵维护意思自治和限制意思自治的双重内容。其中,无效民事行为制度旨在维护意思自治而限制意思自治,因此需要运用无效民事行为转化制度来缓和存在诸多无效民事行为的现实矛盾。通过结合各国家与地区的立法和判例,建议我国构建无效民事行为转化的一般性制度和具体规则,并对物权法与债权法两个领域进行针对性分析,尝试证成我国引入无效民事行为转化制度的可能性。
