警察作为国家机器,其法定职责就在于预防和阻止犯罪,维护社会稳定。近年来,随着暴力犯罪的显著增加,对警察执法提出了更严峻的挑战,警察执法也面临诸多困境:一方面,社会出于安全考虑要求警察严格甚至严厉执法,鼓励警察使用枪械;另一方面,鼓励警察使用枪械行为可能导致警察权力的滥用,从而威胁公民个人权利。而要解决这一矛盾,就必须对警察执法过程中使用枪械的行为性质进行定性,通过对学术界有关警察使用枪械行为的分析,确定警察使用枪械行为的性质,从而规范警察执法中使用枪械的行为。
