随着经济贸易全球化的发展,环境问题也逐步引起了世界各国的广泛关注,由地区走向全球,与贸易之间的冲突也日渐升温。WTO贸易规则与MEAs贸易限制措施之间的冲突成为全球环境与贸易法间律冲突的的集中表现。本文首先对这一表现进行了阐述;其次,分析在WTO体系中对二者的协调;最后,分析了环境与贸易冲突对我国的影响及我国法律对策。
With the development of globalization of economy and trade, environmental issues have also gradually attracted the attention of all countries in the world. From the region to the world, conflicts with trade are also getting more and more heated. Conflicts between the WTO’s trade rules and the MEAs trade restrictions have become the concentrated manifestation of the clash of laws of the global environment and trade law. This article first expounds this performance. Secondly, it analyzes the coordination between the two in the WTO system. Finally, it analyzes the impact of environment and trade conflicts on our country and our legal countermeasures.
