法学思潮从古希腊罗马时期开始出现萌芽,历经西欧中世纪和近代资产阶级重要时期的探索,发展到现代法律学说和思想,这是一个漫长的过程。在现代化的趋势之下,法学家对法学的探索更加趋于多元化,现代法学不断发展,甚至出现了后现代的法律思想。本文以1917年以后的现代法学作为研究对象,在认识历史社会背景基础上,从西方和中国视野研究现代法学的形成。
The trend of jurisprudence started to emerge from ancient Greece and Rome. After going through the exploration of the important period of Western and Middle Ages and the modern bourgeoisie, the trend of jurisprudence developed to the modern legal theory and thought. This is a long process. Under the trend of modernization, jurists tend to explore diversity of jurisprudence more and more. The development of modern jurisprudence has even brought out the post-modern legal thoughts. Based on the cognition of the historical and social background, this article takes modern jurisprudence after 1917 as the research object and studies the formation of modern jurisprudence from the western and Chinese perspectives.
