《物权法》初步建立起我国建筑物区分所有权制度,共有权问题是该制度的核心问题。由于共有权问题而引发的纠纷诸多,其主要原因在于对共有部分的权利归属划分不清。笔者针对业主的建筑物区分所有权之共有权的一系列具体问题的权利归属进行延伸研究,以期在原有理论与现有立法的基础上有所突破。
Property Law preliminarily established the system of building ownership of buildings in our country. The issue of the common right is the core issue of the system. The main reason for the disputes arising from the issue of the right to common ownership is the unclear classification of the ownership of the common part. The author conducts an extension research on the ownership of a series of concrete problems of the owners’ buildings that distinguish the ownership of the ownership, with a view to making breakthroughs on the basis of the original theory and the existing legislation.
