在我国社会转型期,公立学校内部结构治理亟待厘清与调整学校内部各主体之间的法律关系。调整学校内部权力结构关系,就要完善学校内部治理结构,建立决策、执行、监督机构相互独立、相互协调的学校治理模式;鉴于目前学校与教师法律关系的模糊性,两者之间法律关系的调整,有赖于国家对教师身份的明确法律定位以及完善现行的教师聘任制,关键还在于处理好校长的管理自主权与教师的教学自主权的关系;调整学校与学生之间的法律关系,一方面要有利于学校对学生的管理,另一方面学校要充分保障学生的合法权益。
