关于公诉的范围，立法已经较好地解决了公诉的自诉化问题，但应进一步明确自诉的公诉化问题；关于公诉的方式以及卷证材料的移送，应当统一对“主要证据”范围的认识；关于公诉的效力，人民检察院应当享有撤销公诉及变更、追加起诉的权利，并且鉴于立法的规定、人民检察院的性质和为保障审理程序的顺利进行，对于人民检察院提起公诉的案件，人民法院不宜用裁定的方式驳回公诉从而终止公诉的程序效力
