在我国,法院拥有审判监督程序的启动权。刑事诉讼法205条、民事诉讼法177条和行政诉讼法63条均规定最高人民法院和上级人民法院的启动权以及各级人民法院院长提请权。审判监督程序是我国一项重要的诉讼程序,其对象是已经发生法律效力的裁判, 所以它涉及到社会稳定于公平正义之间的冲突。今年来有关法院启动权引起学界的关注及讨论,所以若能从理论上对其加以科学剖析与合理阐释,澄清目前理论界与实务界存在的混乱认识,无疑会具有深刻的实践意义。
In our country, the court has the right to start the trial supervision procedure. Article 205 of the Criminal Procedure Law, Article 177 of the Civil Procedure Law and Article 63 of the Administrative Procedural Law all stipulate the right of starting the Supreme People’s Court and the higher people’s courts and the right of the President of the People’s Court at all levels to draw their votes. The judicial supervision procedure is an important litigation procedure in our country. Its object is the referee that has legally effect, so it relates to the conflict between social stability and fairness and justice. This year’s initiation of the court has aroused the concern and discussion of the academic circles. Therefore, it is undoubtedly of profound practical significance if we can theoretically analyze and justify it scientifically and clarify the current confusion in theorists and practitioners.
