司法工作人员渎职犯罪,是指司法机关工作人员在履行职务的过程中,有滥用职权、玩忽职守或者徇私舞弊等行为,严重危害了正常的司法秩序的行为。司法工作人员渎职犯罪规定在我国刑法渎职罪一章,是三类渎职犯罪之一(后两类是,一般国家机关工作人员渎职罪和特定国家机关工作人员渎职罪)。具体有八个罪名,把司法工作人员渎职犯罪作为一类单独的渎职犯罪加以规定,是因为运用法律进行司法活动的司法工作人员具有特殊的身份,从事的职业十分重要,其渎职犯罪造成的危害比其他类型的渎职犯罪更加严重,因为其职业的特殊性,在人们的理解中司法工作人员的行为往往代表着司法权威,是人们心目中的标杆,如果这类人员在工作中有渎职行为,会使人们丧失对法律的信任,严重损害司法权威。司法工作人员渎职犯罪有着与其他渎职犯罪共同的一面,同时也有着自身不同的特点。本文从我国有关司法工作人员渎职犯罪的法律规定入手,结合相关的司法实践,从该类犯罪的犯罪概念和犯罪构成、司法工作人员的范围、我国相关制度的现状及相应的完善意见等几个方面来对司法工作人员渎职犯罪进行深入的研究。
