为加强医疗广告管理,保障人民身体健康,根据《广告法》、《医疗机构管理条例》、《中医药条例》等法律法规的规定,国家相关部门制定了《医疗广告管理办法》。该办法所称医疗广告,是指利用各种媒介或者形式直接或间接介绍医疗机构或医疗服务的广告。医疗机构发布医疗广告,应当在发布前申请医疗广告审查。未取得《医疗广告审查证明》,不得发布医疗广告。工商行政管理机关负责医疗广告的监督管理。卫生行政部门、中医药管理部门负责医疗广告的审查,并对医疗机构进行监督管理。
In order to strengthen the management of medical advertisements and protect the health of the people, the relevant state departments have formulated the Measures for the Administration of Medical Advertisements in accordance with the provisions of the laws and regulations such as the Advertising Law, the Regulations on the Administration of Medical Institutions and the Chinese Medicine Regulations. The term “medical advertisement” as used in this approach refers to advertisements that directly or indirectly introduce medical institutions or medical services using various media or forms. Medical institutions issue medical advertisements and should apply for medical advertisement reviews before they are released. Have not obtained the medical advertisement examination certificate, may not publish the medical advertisement. The administrative department for industry and commerce is responsible for the supervision and administration of medical advertisements. Health administrative departments and Chinese medicine administrative departments are responsible for reviewing medical advertisements and supervising and administering medical institutions.
