民事诉讼法与行政诉讼法均对原告的资格作了规定 ,但二者的规定是不同的。然而司法实践中 ,人民法院在受理行政案件时 ,往往用民事诉讼法规定的原告资格来要求行政案件的原告 ,致使大量的行政案件的当事人的合法权益得不到有效保护。本文通过对民事诉讼法和行政诉讼法对原告资格字面规定的差异分析 ,结合行政诉讼法的立法精神 ,指出了行政诉讼原告的应有之义
Both the Civil Procedure Law and the Administrative Procedure Law stipulate the qualifications of the plaintiff, but the provisions of the two are different. However, in the judicial practice, when accepting administrative cases, the people’s courts often request the plaintiffs in administrative cases with the qualifications of the plaintiffs stipulated in the Civil Procedure Law so that the legitimate rights and interests of the parties to a large number of administrative cases can not be effectively protected. Through the analysis of the differences between the civil procedure law and the administrative procedure law on the plaintiff qualification, combined with the legislative spirit of the Administrative Procedure Law, this paper points out the due meaning of the plaintiff in administrative proceedings
