随着行政权在现代社会的日益膨胀,公务员权利义务理论的变化,以及法治、人权保障理念的深入人心,内部行政行为不再像过去一样被绝对排斥在行政诉讼的受案范围之外,在许多国家,内部行政行为已经进入了诉讼领域。这为内部行政行为的可诉在我国变为可能。在近阶段,公务员的开除,辞退,工资福利,退休金发放等内部人事管理行为经过行政前置程序后可以纳入行政诉讼范围。
With the ever-expanding administrative power in modern society, the change of civil servants’ rights and obligations theory and the deep popular feeling of the concept of the rule of law and human rights protection, the internal administrative acts are no longer excluded from the scope of the administrative litigation as in the past. In many countries, internal administrative actions have entered the field of litigation. It is possible for our country to prosecute this internal administrative act. In the recent stage, civil servants’ dismissal, dismissal, salary and welfare, pension payment and other internal personnel management activities can be brought into the scope of administrative litigation after passing the administrative pre-procedure.
