伴随着网络的普及,社会运动作为推动中国改革发展的力量,逐步壮大。从助推公平正义实现到促进权利意识觉醒;从促进法律实施到扩大公众参与,再到促进合作治理,社会运动中的抗争和维权,有力地推动了法治建设。社会运动的加入,意味着中国法治发展在国家之外又多了一个主要推动力量,法治发展路径将从“国家主导型”向“国家—社会协作型”转变。同时,网络虚拟社会的新特点,又对社会运动的治理,提出了新挑战。
Accompanied by the popularization of the Internet, social movements have gradually expanded as the forces driving China’s reform and development. From promoting the realization of fairness and justice to promoting the awakening of the awareness of rights. From promoting law enforcement to expanding public participation, and then to promoting cooperative governance, the protests and activists in social movements have effectively promoted the construction of the rule of law. The participation of social movements means that the development of the rule of law in China has added another major driving force outside the country. The path of development of the rule of law will shift from “state-led” to “state-society coordinated.” At the same time, the new characteristics of cyber-virtual society bring about new challenges to the governance of social movements.
