“绿箱”措施是WTO《农业协定》的重要组成部分,但我国“绿箱”措施的结构和力度还远未满足农业发展的需求。目前很多学者认为中国仅使用了12类“绿箱”措施中的6类,本文通过将《农业协定》相关条款与中国现行法律政策对应分析,得出我国实际上已全部使用了12项“绿箱”措施的结论,并在WTO框架下,结合我国具体国情与国家的大政方针,就如何更好地适用“绿箱”措施提出建议。
The “Green Box” measure is an important part of the WTO Agreement on Agriculture. However, the structure and intensity of our “Green Box” measures are far from meeting the needs of agricultural development. At present, many scholars think that China uses only 6 types of 12 types of “green box” measures. By analyzing the relevant provisions of the “Agreement on Agriculture” and the current laws and regulations in China, this article concludes that China has actually used 12 “Green box ” measures. In the framework of WTO, combined with China’s specific national conditions and the country’s major policies, put forward suggestions on how to better apply “Green Box ” measures.
