(一)经纪人的概念一、经纪人与期货经纪人经纪活动具有悠久的历史,可以追溯到古希腊、古罗马时代。经纪人在市场上具有独特的内涵和独立的法律地位。理论上,经纪人的概念有狭义和广义之分。广义上的经纪人是指为了促成他人交易而从事居间、行纪或代理行为的中间人。狭义上的经纪人是指从事居间介绍的中间人。1995年10月,国家工商行政管理局颁布的《经纪人管理办法》,第一次从广义上对经纪人进行规定,《经纪人管理办法》第二条,本办法所称经纪人是指在经济活动中,以收取佣金为目的,为促成他人的交易而从事居间、行纪或代理等业务的公民、法人或其他组织。“(二)经纪人的特征依据上述法律规定,经纪人应该具有以下特征:
