法律的一个重要特征就是其与社会发展相比有着延后性。网络技术的发展是社会发展的关键成就,与之有关的法律条文也在不断地产生与成熟的过程中。今天人们的生活已经是跟网络难以分开,伴随而生的就是许多网络虚拟财产的法律保护困扰。本文首先介绍了网络虚拟财产法律保护的现状,接着对网络虚拟财产的法律保护给出了建议:将虚拟财产进行单独立法、通过司法解释的形式对虚拟财产进行法律保护、创建举证制度等。
An important feature of law is that it lags behind social development. The development of network technology is a key achievement of social development. The related legal provisions are also constantly emerging and maturing. Today people’s lives are already difficult to separate from the network, with the birth of many online virtual property legal protection troubled. This article first introduces the status quo of the legal protection of the network virtual property, and then gives some suggestions on the legal protection of the network virtual property: to separately legislate the virtual property, to protect the virtual property through the judicial interpretation and to establish the proof system.
