朝核问题再次印证了新世纪国际法危机的存在。尽管这是出于实在国际法的固有缺失,但这并不意味着我们可以对此听之任之。这种情况下,需要直接适用强行法以弥补实在国际法的缺失。强行法不需要国家意志的合意即可成立,且其可以被直接适用于国际关系。朝鲜进行核试验的行为是违反“禁止核扩散、限制核试验”的强行法的行为,朝鲜不能摆脱其在强行法下的不进行核试验的义务。
North Korea’s nuclear issue once again confirms the existence of the crisis of international law in the new century. Although this is an inherent lack of real international law, that does not mean that we can do nothing. Under such circumstances, it is necessary to directly apply jus cogens to make up for the real lack of international law. Coercive law does not require the will of the state to be established, and it can be directly applied to international relations. North Korea’s conduct of nuclear tests is a violation of the “Forbidden Nuclear Non-Proliferation, Restriction of Nuclear Tests,” the act of jus cogens. North Korea can not escape its mandatory obligation to not conduct nuclear tests.
