一、我国现行集体土地所有权的内涵 (一)集体土地所有权的主体. 《土地法》第八条规定:“集体所有的土地依照法律属于村农民集体所有,由农村农业生产合作社等农业集体经济组织或者村民委员会经营、管理.巳经属于乡(镇)农民集体经济组织所有的,可以属于乡(镇)农民集体所有.”“村农民集体所有的土地已经分别属于村内两个以上农业集体经济纽织所有的,可以属于各该农业集体经济组织的农民集体所有.”由此可见,(1)集体土地所有权的主体是“农民集体”,不是村民委员会或乡(镇)人民政府,也不是农民个人;(2)集体土地所有权的主体有三种组织形式: 村农民集体、乡(镇)农民集体经济组织、村农业集体经济组织.因此,集体土地所有权的主体具有多样性. (二)集体土地所有权的客体。 《宪法》第十条和《土地法》第六条规定:“农村和城市郊区的土地,除由法律规定属于国家所有的以外,属于城体所有;宅基地和自留地、自留山,也属于集体所有.”根据这一规定,农村和城市郊区的土地,除由法律规定属于国家所有的以外,均属于集体土地所有权的客体,即各集体土地所有权主体在其各自地界内对属于上述法定范围的土地享有所有权.因此,集体土地所有权的客体具有法定性特征.
