1980年以后,随着改革开放的深入、边疆的暴力冲突、西部的生态危机、族群保留传统生活方式思想的复兴,第二代民族政策的论争,这些警示我们,要研究民族区域自治的内在法理根据。文章主要从权利保障、自由—自主权、分权—限权、合作—共治—发展权以及人的尊严等角度出发,给出了民族区域自治内在正当性的法理根据,从而为坚持、发展和完善民族区域自治,发挥民族区域自治的应有作用提供理论基础和信心支撑。
