实现担保物权案件特别程序的适用,不以《物权法》规定的担保物权种类为限,其他法律中所规定的担保物权也可以适用。《物权法》仅就抵押权人、出质人和留置关系中的债务人申请人民法院拍卖、变卖担保财产作了直接规定,基于《民事诉讼法》的实现担保物权案件特别程序的独立性以及质权人、留置权人实现担保物权的程序选择权,质权和留置权的实现均可适用实现担保物权案件特别程序。建设工程价款优先受偿权是《合同法》规定的法定担保物权,船舶抵押权、船舶优先权和船舶留置权是《海商法》规定的船舶担保物权,民用航空器抵押权、民用航空器优先权是《民用航空法》规定的民用航空器担保物权,上述特别法上所规定的担保物权均可适用实现担保物权案件特别程序。
