在事故调查的依法行政中,以事实为依据,要求行政机关的任何执法活动都必须始自调查,以获取的证据证明事实的存在。以法律为准绳,行政机关在查明事实的基础上,准确地适用法律。在依法行政中,程序不仅合法,还要正当。依法行政在对行政执法提出的诸多要求当中,“以事实为依据,以法律为准绳”两条具有基础性和根本性,任何一条不达标都会造成行政执法的错误甚至失败。
