[目的/意义]针对引进国外数据库中的著作权相关问题,拟结合图书馆引进实践与知识产权制度、合同法、竞争法,提出综合应对策略,降低国外数据库引进工作的法律风险并维护图书馆自身合法权益。[方法/过程]将国外数据库引进中的著作权相关问题进行类型化分析,归纳出实践中的6大问题,包括国外数据库开发者与许可方可分离性引起的合同效力风险、著作权效力不稳定引起的合同履行风险、国外数据库商滥用著作权采取不合理的技术保护措施、制定无法实现信息长期保存功能的使用规则以及收取不合理的许可使用费、制定不合理的销售模式等。[结果/结论]针对上述问题,提出开展有针对性的著作权教育计划、制定图书馆国外数据库资源引进标准、注重长期保存许可的获得、选取集体性采购联盟模式并推动许可方的合理许可承诺、引入外部信任机制以及加强著作权风险管理等应对策略。
[Purpose / Significance] Aiming at the issues related to copyright in introducing foreign databases, it is proposed to combine the practice of introducing libraries with the system of intellectual property rights, the law of contracts and the law of competition to propose a comprehensive countermeasure to reduce the legal risks of the introduction of foreign databases and to safeguard the library itself Legal rights and interests. [Method / Process] The author analyzes the types of copyright-related issues in the introduction of foreign databases and sums up six major problems in practice, including the risk of contractual validity caused by the separability of foreign database developers and licensors, and the instability of copyright. Of the contract to perform the risk of abuse of copyrights by foreign database operators to take unreasonable technical measures to protect the implementation of long-term preservation of information can not be achieved using the rules and collect unreasonable license fees, the development of unreasonable sales model. [Results / Conclusion] In view of the above problems, this paper proposes that we should carry out targeted copyright education programs, establish standards for the introduction of foreign database resources in libraries, pay attention to the acquisition of long-term preservation licenses, select the mode of collective purchasing alliance and promote the licensor’s reasonable promise, Introduce external trust mechanism and strengthen countermeasures such as copyright risk management.
