中国的律师管理体制是随着律师行业的改革和迅速发展而不断改革创新的。自1979年恢复律师制度以来,为适应市场经济的需要,律师管理体制经历了从单一的政府管理到司法行政机关与律师行业协会共同管理的“两结合”的基本框架变化过程。但是在现实中,律师管理仍存在很多问题,在文中,通过中外律师管理体制的比较,结合现实,分析得出律师管理中存在的问题,在文章最后,结合实际提出一些个人的观点。
China’s lawyer management system is constantly reforming and innovating with the reform and rapid development of the lawyer’s profession. Since the restoration of lawyer system in 1979, in order to meet the needs of the market economy, the lawyer management system has undergone the process of changing the basic framework of “two combinations” from a single government administration to a joint management of judicial administrative organs and lawyers associations. However, in reality, there are still many problems in the management of lawyers. In this article, through the comparison of Chinese and foreign lawyers management system, combined with reality, the problems in lawyer management are analyzed. Finally, some personal opinions are put forward at the end of the article.
