检察权由诸多不同类型的权力组合而成,并各自在刑事诉讼流程中扮演着不可或缺的角色。目前的检察权配置,正是基于其权能的特质才形成固有模式,表现为精细化分工的内设机构。但是,这样的格局形态却导致司法实践中的权力运行障碍,限制了立法原意的实现,产生了某种“自缚性”。这一问题的解决,有赖于释放办案主体的自主性,以渐进方式破除“部门析出”的体制性障碍。当检察权以相对集中的样态呈现时,或许可以彻底摆脱因其自身功能失灵所造成的反噬,确保内外关系秩序的恢复。为此,需要重新对检察机关的内部组织形式进行排列组合,打破精细化分工的固有格局,代之以具有自主性的办案单元。当然,消除“自缚性”将是一个漫长的过程,科学的方法论在其中发挥着至为关键的作用,并推动提升司法效能、保障司法公正之根本目标的实现。 Prosecutorial power is a combination of many different types of power and each plays an integral role in the criminal process. At present, the configuration of procuratorial powers is based on the characteristics of its power to form an inherent pattern, manifested as an elaborate division of labor within the organization. However, such a pattern has led to obstacles to the operation of the power in judicial practice, limiting the realization of the original intent of the legislation and creating some kind of “self-restraint.” The solution to this problem depends on the release of the autonomy of the main body of handling cases and the gradual elimination of the institutional obstacles to the “separation of departments.” When the prosecutorial power is presented in a relatively concentrated manner, it may be possible to get rid of the bickering caused by its own malfunction and ensure the restoration of the order of internal and external relations. Therefore, it is necessary to rearrange and combine the internal organizational forms of procuratorial organs to break the inherent pattern of fine division of labor and replace them with autonomous case handling units. Of course, the elimination of “self-restraint” will be a long process, in which scientific methodology plays a crucial role and promotes the realization of judicial efficiency and the fundamental goal of judicial justice.
