改革开放30多年来中国大陆的行政法制建设取得显著成绩,对经济、政治、文化、社会的协调和可持续发展起着特殊的推动和保障作用,诸多地方行政规制改革创新经验值得关注和研究。在行政改革深化和行政法制转型的进程中,要积极创造条件充分发挥出地方政府机关推动行政规制改革创新的主动性、积极性以及创造性,行政审批(许可)制度改革的地方经验就是一个缩影。必须正确认识我国行政规制改革创新的社会背景、基本趋势和法治化路向,在行政民主观和现代依法行政理念的指引下,由过去的集权行政、粗放行政、人治行政、管理行政,逐步转向民主行政、科学行政、法治行政、服务行政,稳健推进行政法制建设,才能最终实现建立法治政府和服务型政府的远大目标。首届中国法治政府奖获奖项目为此提供了有益的启示。
