近几年来,一系列文件的出台为民营企业投资国防科技工业提供了政策鼓励与制度支持。但国家对国防资产概念及所有权的法律界定还是国家垄断国防投资时期的内容,难以保障民营企业产权收益。因此,应当将法学与经济学理论相结合,重新界定国防资产概念,厘清国防资产所有权归属,以期避免实践中的权属争议,为推进国防建设提供必要的理论依据。
In recent years, the promulgation of a series of documents has provided policy encouragement and institutional support for private enterprises to invest in the national defense science and technology industry. However, the legal definition of the concept and ownership of national defense assets by the state is still the content of national monopoly period of defense investment, and it is difficult to guarantee the return on property rights of private enterprises. Therefore, it is necessary to combine the theory of law and economics, redefine the concept of national defense assets, clarify ownership of national defense assets, with a view to avoiding disputes over tenure in practice and provide the necessary theoretical basis for promoting national defense construction.
