建平县矿产资源丰富,以铁矿、膨润土矿开发利用程度高,矿产资源分布具明显相对集中特征,造成矿业用地面积大,管理艰难的局面。根据我国关于采矿用地法律法规的规定,采矿用地属建设用地,企业采矿前应依法取得采矿权和地面土地使用权。但受采矿目的、开采技术等的影响,采矿用地在位置选择、使用期限以及对地表土地的影响上存在复杂性和特殊性,造成实践中采矿用地的取得和退出陷入“两头难”的境地。
