随着教师聘任制的实行,传统的教师权利救济制度由于高校与教师之间的法律关系不明以及特别权利关系理论的滞后,致使学校内部管理权力出现法治“真空”。为此应借鉴国外的做法,建立一种适合我国国情的具有公平性和可操作性的教育仲裁制度,在尊重学校管理权的前提下,既保护教师的合法权益,又能发挥国家教育主管部门的监督管理与指导效能。
With the introduction of the teacher appointment system, the traditional remedy system of teachers’ rights causes the “vacuum” of the rule of law in the internal management power of schools due to the unclear legal relationship between universities and teachers and the lag of the theory of special rights. Therefore, it is necessary to learn from foreign practices and establish a fair and operable educational arbitration system that suits our national conditions.
